Please read the following information carefully. There are different types of restraining orders. More commonly there are Domestic Violence, Elder Abuse and Civil Harassment.

Domestic Violence Restraining Orders

In order to obtain a Domestic Violence restraining order, you must meet at least one of the following criteria:

  • You are now married or registered domestic partners.
  • You used to be married or registered domestic partners.
  • You are related by blood, marriage or adoption.
  • You live together.
  • You used to lived together.
  • You are dating or used to date, or you are or used to be engaged to be married.
  • You are parents together of a child or children under 18.

Fees and Forms:

Forms can be obtained from the Family Law Annex located at 540 E. Main Street, Stockton, CA 95202 or downloaded at the California Court’s website at http://www.courts.ca.gov/1271.htm

There is no fee to file a Domestic Violence Restraining Order.

If you submit your papers before 10:00 a.m., the restraining order will be ready the same day between 3:30 p.m. and 4:00 p.m. If you submit them after 10:00 a.m., they won’t be ready until the following day between 3:30 p.m. and 4:00 p.m. All forms must be neatly and legibly printed in blue or black ink or typed. Do not use lined or colored paper for any attachments you may want to make.

Civil Harassment Restraining Orders

Civil Harassment restraining orders can be used for all other situations and relationships. Please be sure to read the General Instructions for Civil Harassment Restraining Orders.

Fees and Forms:

Forms for restraining orders can be obtained from Clerk’s Offices in Stockton, Lodi and Manteca.  The Manteca Branch processes Civil Harassment cases for Manteca and Tracy.  There is a $5.00 fee for Civil Harassment Restraining Order forms.  You may also download forms from the California Courts website at http://www.courts.ca.gov/1281.htm

There may be a fee to file a Civil Harassment Restraining Order.  Please see the “Request for Protective Orders” section in the Court Fee Schedule.

Elder Abuse Restraining Orders

Elder Abuse restraining orders can be used in place of the Domestic Violence restraining order or the Civil Harassment restraining order if the party seeking protection is either age 65 or older and a resident of California or is a resident of California and an adult under age 65 who is unable to carry out normal activities or to protect his or her rights.

There is no fee to file an Elder Abuse Restraining Order.

Staff from the Pro Per Clinic will review your completed domestic violence restraining order forms, Monday, Tuesday, Thursday and Friday from 8:00 a.m. to 2:00 p.m., Wednesday from 8:00 a.m. to 12:00 p.m. on the first floor of the Family Law Annex, located at 540 E. Main Street, Stockton CA.
